KnowFirm — Terms of Service (DRAFT)
DRAFT for owner + counsel review. Not legal advice. Do not publish until reviewed. Operated by persoon.ai. Effective: [DATE].
1. The service
KnowFirm provides a programmatic API delivering business (KYB) and firmographic data — business identity resolution, identifiers, firmographics, and sanctions/denied-party screening — compiled from authoritative public sources. Access is by API key under a metered plan.
2. Permissible use & the FCRA boundary (important)
KnowFirm is not a consumer reporting agency and the data is not a consumer report under the U.S. Fair Credit Reporting Act (FCRA), 15 U.S.C. §1681 et seq. You agree NOT to use KnowFirm data, in whole or in part, as a factor in establishing eligibility for:
- consumer credit or insurance;
- employment (including hiring, retention, promotion, or reassignment);
- housing/tenancy; or
- any other purpose that would make the data a "consumer report" under the FCRA or analogous state law.
KnowFirm is for business-to-business verification, onboarding, compliance, fraud-prevention, and enrichment. You are responsible for your permissible purpose and for any required end-user notices/consents.
3. Data accuracy & "as is"
Data is aggregated from third-party public sources and resolved algorithmically with a confidence score and per-field provenance. It may be incomplete, outdated, or contain errors. KnowFirm is provided "as is" without warranties of accuracy, completeness, or fitness for a particular purpose. Verify material decisions against primary sources.
4. Sanctions screening
Screening results are informational and drawn from the U.S. Consolidated Screening List with a freshness timestamp. They are not legal advice and not a substitute for a sanctions-compliance program. Verify any potential match against the official government source before acting. See the Screening Disclaimer.
5. Acceptable use
Your use is subject to the Acceptable Use Policy, incorporated by reference.
6. Fees & metering
Paid plans are metered by KnowFirm's own usage ledger, which is authoritative. Fees, quotas, and overage are per your plan. Marketplace-purchased access is billed by that marketplace and reconciled against the ledger.
7. Individuals & privacy
Some records may reference individuals (e.g. sole proprietors, officers). Their handling and opt-out rights are described in the Privacy Policy and Opt-Out Policy.
8. Termination, liability, governing law
[Standard termination, limitation-of-liability cap, indemnity, and governing-law clauses — counsel to complete.]
